When seeking an emergency we depend on so many people. We depend on family members to take the rein or we depend on coworkers doing what they can to cover shifts. We depend on friends and neighbors to stalk the fridge and keep us fed. Emergencies take time, patience, and determination. Emergencies catch us off guard and we can only pray that during those moments of what seems like forever, that something good happens or at the least something happens. This was not the case for a family who was in a dire emergency. Instead of getting the care they needed they were left waiting and as a result, a father died when he could have survived. When death happens due to the negligence of someone or some party it is called wrongful death. In November 2016, Brian Gearhart, beloved husband, and father, called an ambulance and was sent to the emergency room with excruciating pain in his stomach. Gearhart had a history of ulcers and abdominal disease. After staying in the hospital for about 2 hours, the doctors confirmed that he had a small hole in his small bowel. It would require a specialist to conduct surgery, but they had someone who could perform the special surgery. This was at 10:45 PM. The family waited and waited yet no doctor arrived to perform surgery until 3:15 AM. This was nearly 4 hours after the medical staff said that Gearhart would need emergency surgery.
The doctor who was on-call said he reached out to another surgeon, but there were no records of such contact. Once the doctor did arrive and perform surgery, Gearhart was already in septic shock and died by the time morning arrived. The daughter knew that something was wrong and knew that had the doctor arrived within the 45 minute arrival time she would still have her dad. The family filed a wrongful death suit against the hospital and the doctor. The hospital failed to have a backup the surgeon and did not perform to the standard of care needed to meet the patient’s need. The family stated that “We just want to make sure that nobody has to feel the way we felt in those moments, and experience a loss that could have been prevented.”
