Bertha Estrada, 19, and another driver stopped on the side of State Route 94 the other day to help out at an accident that had just happened. As she was making sure they were okay, a Jeep struck her and the vehicle. The impact sent her across the freeway and into westbound lanes. Unfortunately, Estrada did not survive her injuries.
“The victim and a driver stopped to assist, so they were two good Samaritans.”
Her friends and family are devastated. Her sister died a few years ago, also in a vehicle accident. Estrada leaves behind a one-year-old son. She was attending college to become a nurse.
At The Law Offices of Eugene G. Bruno, we know that pedestrian accidents are not uncommon. Regardless of the situation, they face many dangers in and around the roadway, often because of negligent drivers.

There are far too many pedestrian accidents in California. For the latest reporting year, there were over 14,000 people injured and 867 killed in pedestrian accidents. San Diego saw thousands of pedestrian accidents in the same year and the numbers do not seem to be going down.
Many people do not realize just how vulnerable pedestrians are when they are around the roadway. In the story above, Estrada was off the road when she was struck. In fact, many pedestrian accidents happen at crosswalks and intersections, places where pedestrians have the right-of-way.
It is not uncommon for pedestrians to suffer from severe injuries that can lead to life-long disabilities. We commonly see head and brain trauma, massive internal injuries, paralysis, and more.
According to the California Department of Public Health, alcohol-impaired drivers are responsible for 35 percent of pedestrian fatalities. When a person makes the choice to drink and drive, they are putting everyone on and around the roadway in danger.
We know that most municipalities are cracking down on distracted driving, but we know that so many drivers still have their eyes glued to the screen of their phones instead of the roadway. This often leads to major pedestrian accidents at both high and low speeds.
Any form of negligent, careless, or aggressive driving is a danger to pedestrians.
